A Tamale High Court has ordered a rerun of the parliamentary elections in the Kpandai Constituency of the Northern Region.
This judgement, delivered by His Lordship Emmanuel Brew-Plange on Monday, followed an election petition filed by National Democratic Congress (NDC) Parliamentary Candidate Daniel Nsala Wakpal.
According to the petition, filed on Thursday, January 30, the results of the elections as declared by the Electoral Commission, Ghana (EC) were invalid due to several irregularities.
Mr Nsala Wakpal, who is a former Member of Parliament, cited inconsistencies in forms 8A in 41 of the the 152 polling stations in the Constituency.
Giving his judgement, Justice Brew-Plange ordered the winner of the December 7 polls, Matthew Nyindam, not to hold himself as the Member of Parliament.
The Court has, therefore, ordered the EC, a Second Respondent in the suit, to hold elections within 30 days of the ruling.
Meanwhile, lawyers of the New Patriotic Party (NPP) MP have filed an appeal against the judgement and a stay of execution.
They are seeking, among others, the setting aside of Justice Brew-Plange’s judgement
They are convinced that the trial judge erred in delivering judgement on the case.
