The Supreme Court has dismissed a suit against the state for the removal of former Chair of the Electoral Commission, Ghana (EC) Charlotte Osei.
The case, filed by veteran journalist Abdul Malik Kweku Baako Jnr, was dismissed on the grounds that the constitutional provision brought before the court needed no interpretation.
Defending the position of the court, lawyer for the plaintiff Sampson Lardi Ayinine argued that the grounds for the dismissal of the immediate past Chair of the Commission on stated misbehavior was not part of her core functions.
Therefore, he further argued, the Chief Justice’s committee that established a prima facie case against her was wrong.
But the apex court of Ghana stood on its ground, stressing that as long as Mrs Osei was a Commissioner of the EC, her behavior affects her office and could not have been disregarded.
A Deputy Attorney General, Godfred Yeboah Dame, argued the suit has no constitutional issues and prayed the court to dismiss it.
He contended that the plaintiff could only rely on a constitutional review instead of filing a fresh case to dismiss the decision of the Chief Justice’s committee.
