No prima facie case found in petitions against Electoral Commission and Special Prosecutor

President John Dramani Mahama has been informed that petitions seeking the removal of the Chairperson of the Electoral Commission, her Deputy Commissioners, and the Special Prosecutor do not present a prima facie case.

The decision follows the referral of seven petitions concerning the Electoral Commission and three petitions regarding the Special Prosecutor to the Chief Justice, His Lordship Justice Paul Baffoe-Bonnie, in line with Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959).

By a letter dated 26th January 2026, the Chief Justice informed President Mahama that the petitions lacked sufficient grounds to warrant further investigations or removal proceedings against the officials named.

Felix Kwakye Ofosu, MP, Spokesperson to the President and Minister of Government Communications, confirmed the update, emphasising the adherence to constitutional processes and the rule of law in handling such petitions.

The President’s office reiterated its commitment to upholding the independence and integrity of constitutional offices and legal institutions in Ghana, noting that all actions taken followed due process.

This outcome underscores the role of the judiciary in assessing allegations against high-ranking public officials and maintaining stability in the governance framework.
