Popular Ghanaian musician Tic Tac, has won GHC300,000 in damages against one of the largest retail shops in Ghana, Melcom, for using his image for billboard advertisements as ambassador for the company without any contract between the two.
The hip life musician sued Melcom in 2016 for breach of contract after he discovered that he was still being advertised as an ambassador of the retail company when a two-year ambassadorial contract between them had expired five years ago.
Per court documents filed on Thursday July 28, 2016 the artiste claimed he lost a similar promotional contract due to Melcom’s failure to remove his images on billboards after the expiration of the contract in May 31, 2011.

He thus prayed the Accra High Court to award a whooping GHC500,000 in damages in his favour against Melcom for breach of contract.
At the end of the hearing, the Court presided over by Justice Amo Yartey, declared as illegal, the continuous use of Tic Tac’s image on the company’s billboards when the ambassadorial contract between them had long expired
The Court thus ordered Melcom to pay the Philomena hitmaker to GHC300,000 in compensation as well as GHC2,000 being the legal fees for the musician.
Counsel for Tic Tac, Gary Nimako Marfo, told journalists Friday described the outcome of the case as signal to all businesses that they cannot take musicians for granted over copyright issues.
“When you use someone’s intellectual property for your business, you must pay them,” Gary Nimako said.
